  • Spanish Organic Law 3/2018 on Personal Data Protection and the guarantee of digital rights (LOPDGDD)
  • Spanish Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), Article 22.2
  • Spanish Data Protection Agency (AEPD) Guide on the use of cookies, current edition

A cookie is a small text file that a website stores on the visitor's device (computer, mobile or tablet) when they access it. Cookies remember information about the visit, such as the chosen language, login status or browsing preferences, and are also used for statistical analysis and advertising purposes.

In addition to cookies in the strict sense, this policy also covers other equivalent technologies for storing or accessing information on the user's device: localStorage, sessionStorage, web beacons, tracking pixels, device identifiers and digital fingerprinting.

3. What cookies does talqi currently use?

talqi.io has been designed following the principle of privacy by default (privacy by design). As of the date this policy was last updated, the Website does not use tracking, advertising or third-party cookies that require consent. The only storage technologies in use are:

3.1 Strictly necessary technical storage

| Identifier | Type | Owner | Purpose | Duration | Legal basis | |---|---|---|---|---|---| | talqi_consent | localStorage | talqi (First party) | Store the user's cookie consent preferences (version, date and accepted categories) | 12 months | Art. 22.2 LSSI-CE — exempt from consent | | theme | localStorage | talqi (First party) | Remember the user's preference between light and dark mode | Persistent until the user clears it | Art. 22.2 LSSI-CE — exempt from consent |

3.2 Cookieless web analytics

The Website uses Cloudflare Web Analytics as its web analytics provider. This service:

  • Does not use cookies
  • Does not use localStorage or sessionStorage
  • Does not perform user fingerprinting
  • Processes data in aggregate and anonymous form
  • Does not allow identification of individual users

Given these characteristics, in accordance with the criteria set out in the AEPD Guide on the use of cookies, this processing is exempt from the prior consent requirement under Art. 22.2 LSSI-CE.

More information: https://www.cloudflare.com/web-analytics/

The following describes the categories of cookies managed by the Website's cookie settings panel. Cookies from non-exempt categories (Analytics, Marketing/Advertising and Advanced Personalisation) are only activated after the user's prior, express and informed consent, given through the Website's own consent management platform (CMP). The user may review the details of each cookie (name, owner, purpose and duration) within the panel itself, by expanding each category.

4.1 Technical cookies (strictly necessary)

These are essential for the operation of the Website and the provision of services expressly requested by the user. They enable, for example, traffic management, session identification, shopping cart retention or security.

They do not require prior consent. If the user disables these cookies, parts of the Website may not function correctly.

Typical examples of cookies that talqi may add in this category:

  • Session cookies for private areas (when the client web panel is enabled)
  • Load balancer cookies for distributing traffic across servers
  • Anti-fraud and anti-CSRF cookies for form protection
  • WhatsApp Business session maintenance cookies where applicable

4.2 Preference or personalisation cookies

These remember user settings to personalise the experience (language, region, dark mode, font size). When configured explicitly by the user and proportionate to the requested service, they are generally also covered by the Art. 22.2 LSSI-CE exemption.

Cookie currently used in this category: theme (light/dark mode).

4.3 Analytics or measurement cookies (future)

These measure and analyse user behaviour on the Website (most visited pages, time on site, navigation paths, conversions). The data obtained is used to improve the service and user experience.

They require prior user consent, unless the analytics solution strictly meets the exemption criteria set out in the AEPD Guide (first-party analytics, aggregate data, no fingerprinting, no unsafeguarded international transfers).

Possible future additions:

| Cookie | Owner | Purpose | Duration | Type | |---|---|---|---|---| | _ga, _ga_*, _gid | Google LLC | Google Analytics 4 — Distinguish users and measure site usage | Up to 2 years | Third party | | _clck, _clsk | Microsoft Corporation | Microsoft Clarity — Anonymised heatmaps and session recordings | Up to 1 year | Third party | | _hjSession*, _hjid | Hotjar Ltd. | Hotjar — On-page behaviour analysis | Session / 1 year | Third party | | mp_* | Mixpanel Inc. | Mixpanel — Product event analysis | Up to 1 year | Third party |

These cookies will only be activated with the user's prior consent through the cookie settings panel. As of the date this policy was last updated, none of them are active.

4.4 Marketing or advertising cookies (future)

These are used to measure the effectiveness of advertising campaigns, display relevant ads to the user on this or other websites (retargeting) and limit the frequency of exposure to the same ad. They may share data with advertising platforms.

They require prior, express and specific user consent.

Possible future additions:

| Cookie | Owner | Purpose | Duration | Type | |---|---|---|---|---| | _fbp, _fbc | Meta Platforms Ireland Ltd. | Meta Pixel — Conversion measurement and retargeting on Facebook/Instagram | Up to 3 months | Third party | | li_sugr, bcookie, lidc, UserMatchHistory | LinkedIn Ireland Unlimited Company | LinkedIn Insight Tag — LinkedIn campaign conversion measurement | Up to 2 years | Third party | | _gcl_au, _gcl_aw | Google Ireland Ltd. | Google Ads — Advertising conversion attribution | Up to 90 days | Third party | | _ttp, ttwid | TikTok Information Technologies UK Ltd. | TikTok Pixel — TikTok Ads conversion measurement | Up to 13 months | Third party |

These cookies will only be activated with the user's prior, express and specific consent through the cookie settings panel. As of the date this policy was last updated, none of them are active.

4.5 Advanced content personalisation cookies (future)

These enable content or features tailored to the individual characteristics or interests of the user (e.g. recommendations, A/B testing segmentation, personalised dynamic content).

They require prior user consent.

5. Third-party cookies and international transfers

When talqi incorporates third-party cookies, these will be managed by the corresponding providers, who act as independent data controllers. Some of these providers may transfer data outside the European Economic Area (for example, to the United States).

In all cases, talqi will ensure that such transfers are protected by adequate safeguards in accordance with Chapter V of the GDPR, including:

  • Adequacy decisions by the European Commission (for example, the EU-U.S. Data Privacy Framework for certified companies in the US)
  • Standard Contractual Clauses (SCCs) approved by the European Commission
  • Binding Corporate Rules (BCRs) where applicable

The user may consult the privacy policies of the third parties referenced here on their respective websites.

| Cookie category | Legal basis | |---|---| | Technical (strictly necessary) | Art. 6.1.b GDPR — contractual performance; Art. 22.2 LSSI-CE — consent exemption | | User preferences (configured by the user) | Art. 6.1.a GDPR — implied consent through active choice; Art. 22.2 LSSI-CE — exemption | | Cookieless web analytics (Cloudflare Web Analytics) | Art. 22.2 LSSI-CE — exemption for aggregate and anonymous processing | | Analytics (with consent) | Art. 6.1.a GDPR — explicit consent; Art. 22 LSSI-CE | | Marketing and advertising | Art. 6.1.a GDPR — explicit consent; Art. 22 LSSI-CE | | Advanced personalisation | Art. 6.1.a GDPR — explicit consent; Art. 22 LSSI-CE |

On their first visit to the Website, the user is shown a cookie settings panel that allows them to:

  • Accept all cookies
  • Reject all non-essential cookies with equal ease
  • Configure granularly which categories to accept and which to reject, reviewing the details of each cookie

The user may modify or withdraw their consent at any time, as easily as it was given, by accessing the "Cookie settings" link permanently available in the Website footer.

Consent is retained for a maximum of 12 months. After that period, or whenever a material change is made to this policy (version change), the user's consent will be requested again.

Withdrawal of consent shall not affect the lawfulness of processing based on consent given prior to its withdrawal. When consent for a category is withdrawn, the associated tools are deactivated and the corresponding cookies are deleted to the extent technically possible.
